Trademark Enforcement Notice

Zenith Data Systems™ is a dormant legacy brand that has been formally reactivated and is presently pursuing federal trademark registration with the United States Patent and Trademark Office (USPTO). Numerous technology and AI companies are currently operating under names such as Zenith, Zenith Data, Zenith Data Solutions, and other confusingly similar variations. This pervasive use has generated substantial marketplace confusion and erroneous association with the Zenith Data Systems brand.
Upon issuance of the federal trademark registration, Zenith Data Systems™ will aggressively enforce its rights under the Lanham Act, 15 U.S.C. §§ 1051 et seq. Enforcement will include, without limitation: (i) issuing unequivocal cease‑and‑desist notices for trademark infringement pursuant to 15 U.S.C. § 1114(1) (likelihood of confusion); and (ii), where warranted, pursuing claims for trademark dilution under 15 U.S.C. § 1125(c). This notice constitutes an unambiguous declaration of our intent to protect and vigorously defend the Zenith Data Systems trademark once registration is granted, and to seek all available legal remedies against any entity employing identical or confusingly similar marks in the technology, software, data, and AI sectors.
To preclude any defense of equitable estoppel, laches, or acquiescence, Zenith Data Systems™ affirms that it has not consented to, authorized, or encouraged any third‑party use of the Zenith Data Systems mark or confusingly similar designations. Zenith Data Systems™ has maintained a consistent policy of monitoring the marketplace for conflicting uses and expressly disclaims any interpretation of prior inaction as permission, waiver, or tolerance of infringement.
Any reliance by third parties on the absence of pre‑registration enforcement will not give rise to a valid estoppel defense. The Lanham Act authorizes enforcement of a federally registered trademark upon issuance, and Zenith Data Systems™ will act promptly and without undue delay to preserve and assert its rights.
